Strata Levy Recovery

Advice for owners corporations and lot owners dealing with unpaid strata contributions, payment arrangements and recovery action.

01

Why levy recovery matters

Owners corporations depend on levies to fund insurance, repairs, maintenance, utilities, management and other obligations of the scheme. When contributions remain unpaid, the shortfall can affect planned works and place additional pressure on other owners.

The Strata Schemes Management Act 2015 (NSW) regulates the levying and recovery of contributions. Recovery should begin with a reliable record of the resolutions, notices, due dates, payments, interest and communications relevant to the lot.

02

Early assessment

Before formal recovery action, it is important to confirm that the contribution was properly determined and levied, that the account is accurate and that the correct owner and address details are being used.

A review can also identify whether there is a genuine dispute, financial hardship, a proposed payment plan or another issue that should be addressed before proceedings are commenced. The appropriate response should be proportionate to the amount, age and history of the debt.

03

How Pezikian Legal can assist

  • Reviewing levy resolutions, notices, ledgers and account statements
  • Checking the calculation of principal, interest and claimed recovery costs
  • Preparing letters of demand and pre-action correspondence
  • Advising owners corporations on payment plans and settlement proposals
  • Advising lot owners who dispute the amount or process
  • Commencing and managing recovery proceedings where required
  • Advising on judgment enforcement and recovery costs
04

Documents to provide

A complete starting file may include the strata roll, minutes approving the relevant contributions, levy notices, a current lot ledger, statements of account, payment-plan records and all correspondence with the owner or strata manager.

Court documents and letters of demand should be reviewed promptly. Deadlines may continue to run even while the parties discuss payment or the underlying strata issue.

05

A practical recovery pathway

Some matters can be resolved through corrected records, clear correspondence or a workable payment arrangement. Others require proceedings and enforcement. Pezikian Legal can help identify the path that protects the owners corporation’s position while accounting for cost, timing and the prospects of recovery.
