Connecting the defect to the legal claim
A visible problem does not by itself establish the cause, responsibility or remedy. Building defect claims can require analysis of the contract, plans, specifications, statutory warranties, applicable building standards, the work performed and the evidence of resulting loss.
Pezikian Legal combines legal analysis with Garren Pezikian’s construction-management and civil-engineering background to help clients identify the technical and contractual questions that need to be answered.
Defects and incomplete work
A matter may involve water ingress, waterproofing, fire-safety systems, structural elements, cladding, finishes, services, departures from plans or incomplete work. The legal pathway can differ between residential, strata and commercial projects and between claims against builders, developers, consultants and other parties.
For residential building work, statutory warranties and specific time limits may apply under the Home Building Act 1989 (NSW). Other claims may arise under the contract, negligence or different statutory regimes. Early advice is important because limitation periods and pre-filing requirements can affect available remedies.
Evidence and experts
The scope and quality of the evidence often determine whether the parties can resolve a defect claim efficiently. Photographs and defect lists are useful starting points, but a properly instructed expert may be needed to identify the defect, cause, required rectification work and reasonable cost.
Legal and technical experts should work from the same documents and a clear set of issues. Pezikian Legal can assist in defining the questions for an expert and aligning the report with the claim or response.
- Building contracts, drawings and specifications
- Variations, site instructions and approvals
- Inspection records, certificates and defect notices
- Photographs, videos and maintenance records
- Expert reports, quotations and rectification scopes
- Correspondence with builders, developers, consultants and insurers
Resolution options
The appropriate pathway may include a rectification request, without-prejudice negotiation, NSW Fair Trading’s building complaint process, mediation, NSW Civil and Administrative Tribunal proceedings or court litigation.
For home building claims, NSW Fair Trading involvement may be required before NCAT accepts an application. The forum, parties, relief and timing should be considered before formal steps are taken.
